ONLINE SALES CONTRACT
CONDITIONS OF USE FOR ON-LINE PURCHASES by Patty's Art Gallery srls located in Strada Rivarotta, 4 - 36061 Bassano del Grappa (VI). In order to offer maximum transparency to purchasers of each product is drafted herein to specify in detail every rule that regulates remote purchases via computer network, consumer code, Legislative Decree September 6, 2005, n.206 in particular, those referred to in Section II, Part II, Title III. For the protection of personal data, the provisions of Legislative Decree 30 June 2003, n.196.
PURCHASE ORDER: To make a purchase you do not need to register. The buyer must only enter your data and directions for delivery: no registration and no password is required. The present is consolidated when Patty's Art Gallery receives the purchase order of the product from the Customer in the site www.pattys.it.
To order a work of art, the Buyer must select the work of art of his choice, place it in his cart and provide the personal information necessary to place the order. Before validation, it must be verified that the information entered in the order summary is correct. Payment will not be charged to the Buyer before his purchase offer has been validated. Validation is carried out within 48 hours by Patty's Art Gallery, in order to guarantee the availability of the artwork by the Seller. If it is no longer available, an email will be sent within 48 hours informing the Buyer and the order will be cancelled. If Patty's Art Gallery does not accept even partially an order, is expressly excluded any right to the Customer to request damages, refund or compensation attributable to contractual or non-contractual liability for direct or indirect damage to persons or property.
The Customer at the time of sending the order declares to be aware of all the conditions of this online sales contract and accepts all the conditions. In compliance with the provisions of art. 52 and 53 of Legislative Decree no. 206/2005 on distance contracts, the customer consumer, when the purchase is completed, must keep a copy of this online sales contract.
PURCHASING METHODS Purchases of products for sale on the site are made at the price indicated therein, to be confirmed at the time of order confirmation. Payment must be made according to the following methods when ordering: CREDIT CARD - PAYPAL - BONIFICATION ANTICIPATED.
DELIVERY The delivery of the products will always be made by Insured Express Courier, to the address indicated by the Customer for shipment. The courier in charge will deliver the goods to the door of the building at street level (house number) and will never be authorized (or required) to deliver at home. The insurance covers the entire value of the work. You are 100% guaranteed against theft or damage that may occur during shipment.
The customer is required to check that the package is in perfect condition, intact, nor wet. Only after this verification the Customer must accept the delivery. We recommend to accept with specific reservation. If the contents inside the package is damaged, the customer will have 24 hours from the date of delivery to contact Patty's Art Gallery, send some clear photos of the damage and ask for insurance reimbursement. Patty's Art Gallery will take care to process the orders as soon as possible, but will not be responsible for any delays by national couriers, due to external causes or force majeure.
RIGHT OF WITHDRAWAL Each customer may, following a purchase, exercise the right of withdrawal in the manner and time required by law.
The communication must be sent by PEC to firstname.lastname@example.org or by registered letter with return receipt at Patty's Art Gallery headquarters within a period not exceeding 14 days from the receipt of the work of art. This communication can also be anticipated by simple email, provided that it is confirmed by registered letter with return receipt within 48 hours and must clearly indicate:
1. Written and signed declaration in which you declare that you want to take advantage of the right of withdrawal
2. The title and the author of the work of art that you want to return
3. The bank details on which to obtain the refund by bank transfer (Cod IBAN- SWIFT).
4. Pay pal address in case the payment has been made with this methodology
5. The e-mail address that we will have to use to communicate the return status
Patty's Art Gallery will then have to carry out the return management by the Buyer and process the refund within 14 days from the date of receipt of the communication on the exercise of the right of withdrawal by the Buyer withholding the costs of transporting the work of art to the insurance company.
Returned works of art that have been damaged or soiled by the Buyer will not be accepted or refunded, Patty's Art Gallery reserves the right to decide at its sole discretion.
INTELLECTUAL PROPERTY The Seller guarantees to be the author of the artwork sold, not to violate laws, regulations and rules in force, nor to prejudice the rights of third parties. It undertakes to protect Patty's Art Gallery and the Buyer in case of actions brought by third parties, guaranteeing their quiet possession. At the time of sale, the Seller assigns to the Buyer the material constitutive element of the work and the rights of representation of the work itself. The Seller, however, retains his moral right over the work of art, as well as the rights relating to its reproduction.
COMPETENT FORUM For the solution of any civil and criminal dispute arising from the conclusion of this contract of sale at a distance, or that is otherwise connected to them, will be devolved to the Court of Vicenza. Without prejudice to the powers provided by the Consumer Code.
